1. Subject
The following general conditions of sale govern the distance selling of access tickets for national and international entertainment and/or cultural events (exhibitions, fairs, festivals, and similar) through the website.
The sale is carried out through the services of the MTicket S.r.l. platform in the name and on behalf of Visiona Soc. Coop., which manages ticketing services for events organized directly and for events organized by third parties.
The issuance of access tickets takes place through the MTICKET Version 1.8 platform, deemed suitable by the Italian Revenue Agency, in its hardware and software components, for the issuance of access tickets, with provision n.2022/384751 of 13 October 2022.
Anyone visiting the event must comply with current Italian laws, the rules and regulations governing it issued by the Event Organizer, available in the Regulations of each Event, and on the websites of the respective events or issued by email upon request or finally displayed at the event venue. Anyone visiting the event must comply with the regulations concerning the pandemic situation (Sars-Covid) in force at the time.
In the case of events organized by Visiona Soc. Coop., the holder of the admission ticket fully indemnifies Visiona Soc. Coop. from any and all liability for damages, thefts, injuries, lesions or other unforeseen and unpredictable events, not directly and demonstrably attributable to the sole and direct responsibility of the Organizer Visiona Soc. Coop., and in particular for all events whose cause has not been ascertained by a person in charge of the Organization (Visiona Soc. Coop.) or by a public security authority.
In the case of events organized by third parties, the holder of the admission ticket always and completely indemnifies Visiona Soc. Coop. (which in these cases solely manages ticketing services through the MTicket platform) from any and all liability for damages, thefts, injuries, lesions or other unforeseen and unpredictable events.
2. Responsibility
The Site offers Users who access the site:
- presale of access tickets
- provision of necessary and ancillary services annexed thereto for presale;
- eventual sale of merchandise related to the aforementioned shows, entertainment, and events.
The User who uses these Services is required to comply with all the General Conditions reported here, which must therefore be read and approved before completing the purchase operation.
These conditions may be modified at any time. Any changes will be effective from their publication. Users are therefore invited to regularly access the Site and consult, before making any purchase, the most updated version of the General Conditions. Each purchase will be governed by the General Conditions in force at the time of the purchase.
3. Definitions
The following definitions apply to these General Contract Conditions, it being understood that plural definitions will apply to the singular term and vice versa:
- Sales Platform: MTICKET ver 1.8 sales platform owned by MMM HOLDING s.r.l. deemed suitable by the Italian Revenue Agency, in its hardware and software components, for the issuance of access tickets, with provision n. 2022/384751 of 13 October 2022. The owner of the sales platform is MTicket S.r.l. with registered office in Via Ettore Romagnoli 6, 20146 Milan - Italy. Ticketing services manager: Visiona Soc. Coop. via Chiaia 41, 80121 Naples as the entity appointed by the event organizer for the sale of access tickets to the event itself through the website ticket.comicon.it (hereinafter Website).
- Event: indicates the exhibition, festival, manifestation, fair, show or performance to which the holder of the access ticket can access.
- Event Organizer: is the actual organizer of the event for which the admission ticket is purchased.
- Event Venue: indicates the physical structure, the building, the set of buildings and lands that constitute the places where a specific Event takes place.
- User: is the person who purchases access tickets to the Event electronically.
- Access Ticket Holder: is the person who legitimately holds an Access Ticket purchased by the User in accordance with these General Contract Conditions.
- Access Ticket:is the document issued by the ticketing services manager, on behalf of the Organizer, through the sales platform that entitles the Ticket Holder to access the Event venue.
- Contract: is the agreement between the User and Visiona Soc. Coop., as direct organizer or as delegated by the Organizer for events not organized directly, which regulates the purchase process of access tickets.
4. Online purchase procedure
To complete a Purchase, the User must, in order:
- choose the event of interest
- choose and/or confirm the requested day and time of participation in the event
- choose, if provided, the type of seat or ticket (subscription, daily or similar)
- choose the price type based on the indications provided by the organizer (ordinary or reduced or entitled to different reductions)
- add the chosen tickets to the shopping cart
- proceed eventually with another or other purchases
- choose, if provided, the type of delivery or shipment of tickets
- enter the data of the holders of each ticket
- check the summary of the purchase data
- correctly enter all the data required for identification, payment and eventual shipment
- proceed with the final confirmation of the transaction
Please note that from the moment the tickets are placed in the shopping cart, the User has 15 minutes to complete the Purchase with payment confirmation. After this time, the tickets will be removed from the cart and will return to public sale.
To complete the purchase, it will be sufficient to enter your data during check-out, or, if the type of event being purchased requires it, the user will be required to register on the site.
The personal data provided and the e-mail address indicated at the time of purchase are necessary for the purchase of the access ticket to the event and possibly also for subscribing to the Visiona Soc. Coop. newsletter (or another organizer in the case of third-party events).
5. Ticket price
The Organizer reserves the right to modify the Price of Admission Tickets at any time, it being understood that, in the case of purchase through the Site, the price that will be charged to the user will be that indicated on the Site and in the Order Summary and that no account will be taken of any variations (neither increasing nor decreasing) subsequent to the transmission of the order.
Any agency fees: a fee established by the retailer, as remuneration for the services rendered, due and fiscally attributable to the retailer itself. The agency fee will never be refundable even in the event of cancellation of the event.
Ancillary or service costs: in some cases, depending on the choices made by the user, ancillary costs may be added to the practices, such as, by way of non-exhaustive example, the shipment of tickets, any insurance coverage, other expenses.
Total amount: Sum of the value of all access tickets plus any agency fees and ancillary or service costs. All prices indicated are expressed in Euros and must be considered inclusive of VAT (where required by law).
N.B. The value of the ticket, the presale, the agency fees and any ancillary or service costs are distinctly indicated during all phases of the purchase, in the order summary and in the order confirmation email.
6. Payment methods
The payment methods for the purchase of Admission Tickets are those viewable and made available on the Site from time to time. Visiona uses secure payment services through the following payment gateways: Nexi.
Payments will be managed through secure connections and the data necessary for transactions will be transmitted directly to the payment manager without passing through the servers used by MTicket, therefore the Manager is unable to access any sensitive data regarding the transaction, nor is it able to intervene in case of a denied transaction for any reason.
In any case of refund, for any reason, the refund amount will be credited to the same payment method used by the Customer for the initial transaction; if this is not possible, the refund will be made by bank transfer, in which case Visiona will ask the user for the bank details necessary to make the refund.
7. Ticket Delivery and Event Access Methods.
The delivery of Admission Tickets purchased on the Site can be made, depending on the characteristics of the event, at the user's choice and upon payment of the relative costs if foreseen, with the following different methods that will be indicated in advance for each individual event:
- delivery to the postal address indicated in the "Address" phase of the purchase procedure;
- delivery by immediate printing of the Admission Ticket sent in PDF;
- collection at the event venue or designated location.
Both PDF tickets and the purchase confirmation can be presented in both digital and paper format.
All users must have a valid Admission Ticket to access the event. The Admission Ticket constitutes an access title exclusively for the Event for which it was issued, on the day and at the time indicated therein.
The Organizer has the right to refuse access to the Event Venue for irregularities of the Admission Ticket or Purchase Confirmation or in the event that one of the two is lost, stolen, destroyed, damaged, deteriorated or even only partially illegible as presented by the Customer not perfectly intact; the Organizer also has the right to carry out personal checks for security reasons and also because admission tickets are always nominative and for this purpose it is mandatory to present a valid and current identity document upon request.
8. Event postponed or cancelled
In case of cancellation, postponement or change of an Event for which the User has made the Purchase, the rules and methods adopted from time to time, according to law, by the Organizer, the sole responsible for the Event, will apply.
The Ticketing Services Manager will communicate all changes and information to the User via email as soon as possible.
In the event of cancellation of the Event, a refund will be made to the user, according to the methods and timing decided by the Organizer and the Ticketing Services Manager. The user is reminded that the Ticketing Services Manager, in case of cancellation of the Event, reserves the right to retain the Presale and service costs.
If partial and/or total refunds of tickets are foreseen, or substitutions with other tickets, ticket.comicon.it will act as any other presale agency, refunding the value of the tickets or part of this value, net of any agency fees and payment commissions. In case of non-performance of the Event, the refund can only and exclusively be issued with the return by the User of the intact access ticket, in order to allow its fiscal cancellation as provided by law. In case of non-intact return of the ticket or within the terms established by law, nothing can be refunded and the Organizer or the Ticketing Services Manager will have the obligation to fulfill the fiscal obligations of the non-refunded sums. In any case of cancellation and/or postponement of the Event, the Customer may contact the Organizer to assert all his rights against the same.
9. Exclusion of the Right of Withdrawal.
With the payment, the Buyer concludes the purchase, accepts and confirms the content relating to the Event.
Before concluding it, the Buyer undertakes to carefully verify all the data relating to it (by way of example only: personal data and email, event date, types of tickets chosen, dates and anything else). These data can no longer be modified.
In case of electronic sale, the right of withdrawal is excluded pursuant to article 59 (exceptions to the right of withdrawal referred to in articles 52 to 58 of the Consumer Code, paragraph 1, letter n) of the Consumer Code (services concerning leisure activities if the contract provides for a specific date or period of execution). In this regard, reference is also made to the provisions of Legislative Decree 22 May 1999 n° 185 art.7 paragraph 1 letter b) and Legislative Decree 06 September 2005 n° 206 art. 55 paragraph 1 letter b) and subsequent amendments.
Therefore, no waivers, partial or total chargeback/refund requests for the Purchase, cancellations, changes of dates and times of visit and entry, changes of ticket types and prices, for any valid reason, by the User after the Purchase has been concluded and confirmed, will be possible.
Specifically, in compliance with the regulations in force, it is recalled that the sale of access tickets for shows and entertainment provides simultaneously with the payment for the issuance of the same tickets (with attribution of fiscal seals) through an automated ticketing system, certified and authorized by the Italian Revenue Agency.
Tickets are valid exclusively for the event and date chosen and for the type of ticket and price for which they were issued, with the name and surname of the person who will be entitled to entry, subject to identity verification. Therefore, in the event of renunciation, even for any justified and serious reason and/or impediment, by the Buyer to access/participate in the Event, no refund, even partial, is provided by the Manager or Organizer, neither of the price relating to the cost of the event, nor of the presale rights, nor of agency fees, nor of other costs incurred by the Buyer on his own behalf (by way of example, travel or accommodation expenses).
10. Applicable Law and Competent Court
The Contract is understood to be concluded in Italy and is subject to Italian law.
For any dispute, the court of Naples will have exclusive jurisdiction.
